Draft notice: this document is an initial draft prepared for legal review and has not yet been reviewed or approved by an attorney. It should not be relied upon as a final or legally binding statement until that review is complete.

1. Respect for intellectual property

GoYou Brands LLC ("GoYou Brands," "we," "us," or "our") respects the intellectual property rights of others and expects users of Meldio to do the same. This Copyright & DMCA Policy explains how a copyright owner can report suspected infringement, how a user can respond to a takedown, and how we handle repeat infringement, in accordance with the Digital Millennium Copyright Act ("DMCA"), 17 U.S.C. § 512.

2. Filing a notice of infringement

If you believe that content available through Meldio infringes a copyright you own or control, you (or your authorized agent) may send our Designated Agent a written notice that includes all of the following, as required by 17 U.S.C. § 512(c)(3):

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright interest claimed to be infringed;
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple works are covered by a single notice, a representative list of such works;
  3. Identification of the material claimed to be infringing, and information reasonably sufficient to permit us to locate it (for example, a project name, URL, or account identifier);
  4. Your contact information, including your address, telephone number, and an email address;
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
  6. A statement, made under penalty of perjury, that the information in the notice is accurate, and that you are the copyright owner or are authorized to act on the copyright owner's behalf.

Notices should be sent to our Designated Agent using the contact information in Section 5 below. An incomplete notice may delay our ability to act on it.

3. Our response to a valid notice

Upon receipt of a notice that substantially complies with the requirements above, we will act expeditiously to remove or disable access to the identified material, and will make a good-faith effort to notify the user who submitted the material of the removal and the reason for it.

4. Counter-notification

If you are a Meldio user and believe material you submitted was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notification to our Designated Agent that includes all of the following, as required by 17 U.S.C. § 512(g)(3):

  1. Your physical or electronic signature;
  2. Identification of the material that was removed or disabled, and its location on the Service before removal;
  3. A statement, made under penalty of perjury, that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification of the material;
  4. Your name, address, and telephone number; and
  5. A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the United States, for any judicial district in which GoYou Brands LLC may be found), and that you will accept service of process from the person who submitted the original infringement notice.

Upon receipt of a valid counter-notification, we will forward it to the original complaining party. Unless that party informs us within 10 business days that it has filed a legal action seeking a court order to restrain the user from engaging in the infringing activity, we may restore the removed material within 10–14 business days of receiving the counter-notification, as provided by 17 U.S.C. § 512(g).

5. Designated Agent

Notices and counter-notifications under this policy should be directed to our Designated Copyright Agent:

6. Repeat infringer policy

In appropriate circumstances, GoYou Brands LLC will terminate, or restrict access to Meldio for, users who are determined to be repeat infringers of the copyright rights of others.

7. Misrepresentations

Please be aware that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake, may be liable for damages, including costs and attorneys' fees, incurred as a result of that misrepresentation.

8. Relationship to our Terms of Service

This policy supplements, and should be read together with, our Terms of Service, which separately requires that content submitted to Meldio not infringe another party's intellectual property rights.
